Article 1 — Purpose of the Service
Eternavitas is a conversational assistance service in nutrition, based on a proprietary doctrinal framework. The service consists of access to an intelligent agent capable of providing personalized perspectives, analyses, and dietary guidance based on a declared user profile.
Eternavitas is neither a medical service, nor a paramedical service, nor a nutritional advice service in the regulatory sense. Eternavitas does not establish any diagnosis, prescribe any treatment, and in no way replaces a consultation with a qualified health professional.
Article 2 — Registration and Access
To access the service, the user must:
- Create an account with a valid email address and password.
- Subscribe to a paid subscription via the Stripe payment platform.
- Complete a structured user profile.
- Explicitly accept these TC, the Privacy Policy, and, where applicable, specific disclaimers related to certain objectives (see article 6).
The user guarantees that the information provided is accurate and up-to-date.
Article 3 — Pricing and Payment
The subscription price is €50.00 including tax per month, automatically debited each month via Stripe from the subscription date.
Payment is made by credit card. Eternavitas does not store any banking data — the entire payment flow is managed by Stripe, a PCI-DSS certified provider.
Article 4 — Right of Withdrawal
In accordance with articles L. 221-18 and following of the Consumer Code, the user has a period of 14 days from the subscription to exercise their right of withdrawal, without having to justify their decision.
However, by expressly requesting the immediate execution of the service at the time of subscription (dedicated box to be checked separately), the user acknowledges that their right of withdrawal expires as soon as they start actively using the service (sending a first message to the agent), in accordance with article L. 221-28 13° of the Consumer Code.
As long as the user has not sent any message to the agent, their right of withdrawal remains intact for 14 days.
To exercise the right of withdrawal, contact: contact@eternavitas.org. The refund occurs within 14 days following the request.
Article 5 — Duration and Termination
The subscription is concluded for an indefinite period and is tacitly renewed each month.
The user can terminate their subscription at any time from their "My Profile" area or by contacting contact@eternavitas.org. Termination takes effect at the end of the current monthly period. No pro-rata refund will be made.
Eternavitas reserves the right to unilaterally terminate a user's subscription in the event of a manifest violation of these TC (notably fraudulent use, hateful remarks, attempt to scrape or resell content).
Article 6 — Medical Disclaimer and Specific Consents
6.1 — General Medical Disclaimer
Eternavitas does not provide medical advice. The content provided by the agent constitutes a constructed doctrinal perspective, for informational and educational purposes. They do not in any way replace:
- A medical consultation with a doctor or qualified health professional.
- A medical diagnosis established by an authorized professional.
- An individualized therapeutic or nutritional prescription.
The user is solely responsible for the decisions they make regarding their diet, health, and lifestyle. In the event of a diagnosed pathology, ongoing medical treatment, pregnancy, breastfeeding, growth of a minor, or any other particular medical context, the user agrees to consult a health professional before making any significant changes to their dietary habits inspired by the content provided by Eternavitas.
Eternavitas, its publisher, subcontractors, and assigns disclaim all liability for the direct or indirect, foreseeable or unforeseeable consequences that may result from a literal, partial, or complete application of the content provided by the agent, in the absence of prior medical advice.
6.2 — Specific Consents (Sensitive Objectives)
If the user selects the following objectives in their profile:
- "Repair / recovery from illness"
- "Pregnancy / breastfeeding"
A specific consent step is presented to them, distinct from the general acceptance of the TC. The user cannot select these objectives without having explicitly acknowledged:
- That Eternavitas is not a medical service and does not replace follow-up by a health professional.
- That they consult or have consulted a health professional.
- That they use Eternavitas as a complement, never as a substitute.
The record of this consent (timestamp, user ID) is kept for evidentiary purposes.
Article 7 — Limitation of Liability
Eternavitas undertakes to provide the service diligently, without however guaranteeing:
- Uninterrupted availability (notably in case of maintenance, subcontractor failure, or force majeure).
- The absolute accuracy of the content produced by the agent (the agent may, despite controls, produce errors or approximations).
- The individual relevance of recommendations for each user in all situations.
The liability of Eternavitas, in the event of an established contractual breach, is limited to the total amount paid by the user over the last 12 months.
Article 8 — Intellectual Property
All content produced by Eternavitas (doctrine, knowledge base, agent formulations, service structure) is protected by copyright. The user has a strictly personal and private right to use the service.
The following are strictly prohibited:
- The reproduction, copying, distribution, or republication of the agent's responses for commercial or public purposes.
- The use of the service or its outputs to train or feed another artificial intelligence model.
- Scraping, reverse-engineering, or any massive extraction of content.
Article 9 — Personal Data
The processing of personal data is governed by the Privacy Policy accessible separately.
Article 10 — Mediation and Applicable Law
These TC are governed by French law.
In case of dispute, the parties agree to seek an amicable solution before any contentious action.
In accordance with articles L. 612-1 and following of the Consumer Code, the consumer user can resort to a consumer mediator free of charge. Eternavitas is in the process of joining an approved mediator. The mediator's contact details will be communicated in these TC as soon as the membership is finalized. In the meantime, the user can contact contact@eternavitas.org for any amicable dispute.
In the absence of an amicable resolution, the dispute will be submitted to the competent courts of the jurisdiction of the publisher's domicile, unless otherwise required by law (notably in consumer matters, where the user can bring the case to the court of their own domicile).
Article 11 — Modification of the TC
Eternavitas reserves the right to modify these TC. Any substantial modification will be notified to the user by email with a 30-day notice. The user remains free to terminate their subscription if they do not accept the new TC.
Article 12 — Acceptance
At the time of registration, the user must check two separate boxes:
- "I have read and accept the Terms and Conditions and the Privacy Policy."
- "I request the immediate execution of the service and acknowledge that my right of withdrawal will expire upon sending my first message to the agent."
Both boxes must be checked separately to validate the registration.
